1. Introduction

1.1 These General Terms and Conditions define the rules for using the Colmfi online store and regulate the terms of sale agreements for all orders placed through our website. By using the service and making purchases, you accept the following rules, which aim to ensure transparency and security for every transaction between the Colmfi boutique and our Customers.

1.2 You can find the meaning of the terms used in these terms and conditions in article 23 (“Definitions”).

2. Acceptance of Terms

2.1 

By using the Colmfi website or choosing to place an order, you declare and confirm that:

• a) you are an individual over 18 years of age;
• b) you have full legal capacity, which allows you to conclude a binding sales agreement;
• c) you are not subject to any legal or contractual restrictions that could prevent the effective conclusion and execution of an agreement with our store.

2.2 Colmfi reserves the right to ask you for written confirmation that you are indeed authorized to accept these terms.

2.3 You further warrant that:

(a) you have not been convicted of crimes related to computer abuse or online activity; and
(b) you have not been previously excluded from using our services or accessing our online store.

2.4 Colmfi has the right to restrict or deny you access to (parts of) the website if necessary to protect our services, other customers, or due to applicable laws.

2.5 By placing an order in the Colmfi online store, you explicitly confirm that:

• a) you have read the content of these General Terms and Conditions, fully understand them, and unreservedly accept their provisions;
• b) you acknowledge that your order and the sales process are subject exclusively to the provisions of these regulations;
• c) you acknowledge that these terms constitute the sole basis for cooperation and no other arrangements outside of those contained herein are valid;
• d) you undertake to faithfully comply with all obligations and rules resulting from these terms.

2.6 If you do not agree with these terms, please do not use our website or place orders.

2.7 To use certain features or finalize a purchase, prior, explicit acceptance of these terms may be required.

2.8 By using our website or placing an order:

(a) you also accept our privacy policy; and
(b) you agree to our responsible use of services policy (see article 12).

2.9 We recommend saving or printing a copy of these terms for your own archiving purposes.

2.10 If you do not agree with these terms (or part thereof), we advise you to refrain from contacting us and using our services.

3. Private Use

You declare that you use the Colmfi online store solely for private purposes. This means that:

• you purchase products as a consumer, not on behalf of a company, association, or third party;
• you do not resell purchased products and do not use them for commercial purposes.

4. Prices and Additional Costs

4.1 All prices on the Colmfi website are given in Polish Zloty (PLN) and include the VAT applicable in Poland (23%) and other required fees. Shipping costs are included in the product price, unless otherwise stated.

4.2 Note: If you place an order from outside Europe, additional import charges, such as customs duties and local taxes, may apply. These costs are borne solely by the customer.

For questions regarding potential import costs, we recommend contacting customer service or local customs authorities.

4.3 Colmfi makes every effort to ensure that information, including prices and product descriptions, is correct. In case of a pricing error, we will contact you as soon as possible. You then have the option to:

• confirm the order at the correct price; or
• cancel the order free of charge.

4.4 In case of an obvious pricing error, we are not obliged to deliver the product at the incorrect price, even if you have received an order confirmation.

4.5 We reserve the right to change prices at any time. These changes do not apply to already confirmed orders.

5. Order and Confirmation

5.1 Once an order is placed, it will be processed subject to availability. If available, you will receive an order confirmation by email.

5.2 A binding purchase agreement is concluded only upon receipt of the order confirmation.

5.3 If you have ordered multiple products, they may be shipped separately.

5.4 Colmfi may remove or change products in the offer without prior notice.

5.5 We may refuse or cancel an order in whole or in part, e.g., due to technical errors, pricing errors, or suspected fraud.

5.6 If we cancel an order after payment, we will refund the full amount using the same payment method.

6. Payment

6.1 At the Colmfi store, we provide secure and verified payment methods, including payment cards (Mastercard, Visa). All transactions are encrypted, ensuring the highest level of protection for your financial data.

6.2 Colmfi is not responsible for the unauthorized use of a payment card or other payment instrument by third parties, unless this situation results from direct negligence on the part of the service.

6.3 By placing an order, you declare that you are authorized to use the chosen payment method and undertake not to make unjustified chargeback claims. For questions regarding transactions, we encourage you to contact our Customer Service directly to resolve the matter quickly.

7. Delivery

7.1 We deliver the order to the address specified during checkout.

7.2 The estimated delivery time is indicative.

7.3 If delivery is not possible, the order will be canceled and refunded.

7.4 The risk of loss or damage passes to the customer upon delivery.

8. Order Cancellation or Modification

8.1 To cancel an order, please contact us as soon as possible. We can only cancel an order before it has been shipped.

8.2 Cancellations and Refunds If an order has already been shipped, it cannot be canceled, but it can be returned in accordance with our Return Policy. In the event of a lost return shipment, the verification and refund process will be initiated immediately upon the customer providing proof of package dispatch.

8.3 The order system operates automatically, so we usually cannot stop processing after payment.

9. Defective or Damaged Products

9.1 Products are not custom-made.

9.2 Product information is provided "as is."

9.3 Images are for illustrative purposes.

9.4 If you receive a defective product, please contact us and include photos.

9.5 Upon acceptance, you may return the product.

9.6 Upon receipt, we will conduct a verification.

9.7 We will inform you of the result via email.

9.8 In case of a legitimate defect, we offer:

(a) product replacement; or
(b) a full refund.

9.9 If the product is not defective, we may refuse a refund and charge administrative costs.

10. Right to Return and Refund

10.1 In accordance with consumer law in the EU, every customer has the right to withdraw from the contract within 14 days. Colmfi voluntarily extends this period to 30 days.

10.2 The right of return applies to all products, including sale items, provided they are in an undamaged condition.

10.3 Return shipping costs are borne by the customer, unless the product is defective or damaged.

10.4 Refunds are issued after the goods are received and inspected.

10.5 The product must be:

• in its original condition,
• with all tags and packaging,
• well-protected.

10.6 If the product does not meet the return conditions, we may refuse a refund.

10.7 If everything is in order, the refund will be processed within 7 business days.

10.8 The refund will be issued after the shipment has been inspected.

11. Discount Codes and Gift Vouchers

11.1 Colmfi offers discount codes or vouchers.

11.2 Codes can be entered on the payment page.

11.3 Only one code can be used.

11.4 Codes have no monetary value.

11.5 In case of underpayment, the difference can be settled using an available payment method.

12. Permitted Use of the Website

12.1 The website may only be used lawfully. Prohibited activities include, among others:

(a) performing illegal activities;
(b) distributing malware or viruses;
(c) scraping or automated data retrieval;
(d) using bots;
(e) violating robots.txt;
(f) spam;
(g) using data to contact third parties;
(h) reverse engineering;
(i) creating competitive products;
(j) reselling access;
(k) sharing access on corporate networks;
(l) modifying or copying website content.

12.2 You are responsible for damages resulting from violating the rules.

12.3 You undertake to report abuses.

13. Links to and from Other Websites

13.1 The website may contain links to third-party sites.

13.2 Colmfi is not responsible for the content of external websites.

13.3 You may link to our site fairly and legally.

13.4 You must not suggest cooperation without consent.

13.5 You may only link from domains you manage.

13.6 We reserve the right to withdraw consent.

14. Intellectual Property

14.1 The website structure and code are protected by copyright.

14.2 All content belongs to Colmfi or its licensors.

14.3 Content may only be used for personal use.

14.4 In case of infringement, please contact us.

14.5 Names, logos, and trademarks may not be used without permission.

15. Personal Data Protection

15.1 The privacy policy is an integral part of the terms and conditions.

15.2 Colmfi uses cookies in accordance with the privacy policy.

15.3 Data is treated confidentially and protected in accordance with regulations.

15.4 Data may be transferred to appropriate persons only if necessary.

16. Security, Viruses, and Abuse

16.1 We strive to maintain website security, but we do not guarantee the absence of errors or viruses.

16.2 You are responsible for the security of your own devices.

16.3 It is prohibited, among other things, to introduce viruses, attempt to access databases, and perform DDoS attacks.

16.4 Any attempt at sabotage is a serious violation.

16.5 We may block access and report the matter to the authorities.

17. Limitation of Liability

17.1 We are not responsible for damages resulting from, among other things:

(a) third-party content;
(b) errors in information;
(c) differences in colors or descriptions;
(d) decisions made based on information from the website;
(e) website downtime;
(f) delays and force majeure.

17.2 We are not responsible for indirect damages, lost profits, reputational damages, or financial losses.

18. Indemnification

18.1 You agree to indemnify Colmfi against damages resulting from a breach of these terms or improper use.

18.2 We may demand reimbursement of legal and administrative costs.

19. Force Majeure

19.1 In the event of force majeure lasting more than 7 days, we may terminate the contract.

19.2 Force majeure includes, among others: natural disasters, pandemics, power outages, strikes, cyberattacks.

20. Changes to Terms

20.1 Terms may be changed at any time.

20.2 If you do not agree with the new terms, stop using the website.

20.3 For significant changes, we may ask for re-acceptance.

21. Breach of Terms

21.1 In case of breaches, we may:

(a) send a warning;
(b) temporarily block access;
(c) cancel orders;
(d) refuse payment;
(e) permanently block the account.

21.2 Circumventing blocks is prohibited.

22. Governing Law

These terms are governed by Polish law. Every consumer has the right to use out-of-court complaint and claim resolution methods (e.g., via the ODR platform: http://ec.europa.eu/consumers/odr).

23. Definitions

The following definitions apply in these terms:

• Order – a request to purchase products submitted by you.
• Order Confirmation – an email confirming acceptance of the order.
• Payment Operator – an external entity processing payments.
• Product – any item offered by Colmfi.
• Website – the official Colmfi online store.
